Pursuant to the Rule 12A and 11(2) and (3) of the Companies (Appointment and Qualification of Directors) Rules, 2014, those individuals who have DIN/DPIN shall submit an e-form DIR 3 KYC to the Central Government on or before 31st August, 2018 for the purpose of updating the personal identification details of the director concerned.
Accordingly, the MCA is conducting KYC for all DIN/DPIN holders. The same must be updated before or on 31st August, 2018 and later yearly. Listed below are some of the important points to be considered before filing DIR 3 KYC.
Director KYC is a form of ROC Filing i.e., DIR 3KYC when a director has a DIN No. (Director Identity No.) and it is mandatory to file for every allotted DIN NO.
Director KYC is easy to file through online from anywhere. When a DIN no. has been allotted before 31March 2020, the last due date is 31st December 2020 for filing Director KYC if it is not filed before the due date, the penalty will be liable to pay of Rs. 5000/-.

The residential address proof of the director is the only attachment which is required to be attached with the DIR-3 ( Form for KYC of Director).For attachment to the Form DIR-3,a scanned copy of self-attested address proof is to be prepared.
In the e-form, the personal mobile number and email address needs to be mentioned, for generating the OTP the person has to click on the button within the form, thus the OTP that would generate remains valid for only 15 minutes.
The form needs to be signed by the digital signature of the director concerned, when the form is completely ready, and further a practicing professional who should be either a CA, CS or Cost and Management Accountants (CMA) needs to certify it.
As per recent announcement of MCA, any director who was allotted a DIN by or on 31 March 2018 and whose DIN is in approved status, will have to submit his KYC details to the MCA. Even more, this process is compulsory for the disqualified directors as well.
For FY 2017-18, in cases where a director who is supposed to submit that the e-Form does not file this from the 5 October 2018 (that the drawn-out due date) The department of this MCA will indicate the DIN of this director as 'Deactivated due to Non-filing of DIR-3 KYC'.
In case the director wants to reactivate his DIN in long run by filing the missed-out e-form DIR-3 KYC, he can do after having a late penalty of Rs 5,000. This fee would be set or after 5th oct, 2018. This type should be registered yearly from the directors.
Every Directors unique personal mobile number and email address will have to be provided while filing the eForm. The mobile no. and email id will be verified with OTP( one time password).
The second processor would be that the director has to use his own digital signature while filing this eForm.
Further, the third test to ensure that complete and right information is provided will be that the eForm should be certified by a practising CA(Chartered Accountant) or CS (Company Secretary), or CMA(Cost and Management Accountant).
Some documents are required for DIR -3KYC :-
OTP shall be generate at the end after affixation of DSC, prescrutinize etc.
However it is no where mentioned in the form or rules. But as per the past practice one can opine that ID proofs of foreign DIN holders are required to be appostile and notarized as per their country law and treaty of India with them.
